Thinkwork, LLC (“us”, “we”, or “our”) operates the https://app.gosnapsign.com and the https://www.gosnapsign.com, https://www.thinkwork.com websites, and all related subdomains thereof  (collectively, the “Service”).

While using our Service, we may collect certain personally identifiable information that can be used to contact or identify you.  As further described below, personally identifiable information may include, but is not limited to, your email address, name, phone number, postal address, or other information that may, alone or in combination with other data, allow an individual to be personally identified (“Personal Information”).  This page informs you of our policies regarding the collection, use and disclosure of your Personal Information when you use our Service.

We will not use or share your Personal Information with anyone except as described in this Privacy Policy.

What Data We Collect

We collect and receive data from you in the ways that we have outlined below.  The collection and receipt of this data is necessary for the performance of our obligation to provide the Service to you. 

Legal Basis for Processing [European Union and Switzerland]

For individuals within the European Union or Switzerland, we will only collect your information when we have a legal basis to do so.  The legal basis we use depends on how you use the Service as well as what specific features of the Service you use.  This will mean that we will only collect and use your data under the following conditions:

  • In order to provide the Service to you.
  • If it satisfies our legitimate interests (and only when our legitimate interests are not overridden by your personal data protection interests).  
  • If you have given us your consent to do so for an express purpose.
  • In order to comply with a legal obligation.

User Accounts

In order to use the service, you are required to create an account and in so doing provide your name, email address and/or phone number.  We may email you at your email address or text you at your phone number in order to confirm your registration and in order to provide the Service.  You may also be required to provide an address for billing purposes.  

Service Transactions

We also collect data related to transactions or signature requests that you initiate within the Service, including the name, email address and phone number of individuals that are participants to those transactions or signature requests.  Additionally, we also collect information about participant’s interactions with a transaction or signature request for audit purposes. 

Contact Us Form

If you fill in and send us a request via a Contact Us form, we will collect your email address and your name if provided.  

User Feedback

You may elect to send us feedback via several email addresses that we may display in the Service, including but not limited to support@gosnapsign.com, info@gosnapsign.com, or via our help center (https://help.gosnapsign.com), or via our website (https://www.gosnapsign.com), or via social media.  From this feedback, we may collect your email address and name if provided.   

Log Data

We may also collect information that your browser sends whenever you visit our Service (“Log Data”).  This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, operating system, unique device identifiers, the pages of our Service that you visit, the time, date and physical location of your visit, the time spent on those pages and other statistics.

Cookies

Cookies are files with a small amount of data, which may include an anonymous unique identifier.  Cookies are sent to your browser from a web site and transferred to your device.  We use cookies in order to provide our service for you.

The Service is not compatible with Do Not Track browser requests and is not modified based upon Do Not Track settings.

We use marketing analytic tools and collect data about your use of the Service.  This is collected in an anonymous manner. 

Purchases

You may make purchases on the Service.  If you choose to make a purchase on the Service, we will collect your email address, name, credit card number and your address.

We may aggregate data that we collect or receive in an anonymous manner in order to facilitate Service performance benchmarking and/or optimization, or to enable market research.

We may employ third party companies and individuals to facilitate our Service, to provide the Service on our behalf, to perform Service-related services and/or to assist us in analyzing how our Service is used.

These third parties have access to your Personal Information only to perform specific tasks on our behalf and are obligated not to disclose or use your information for any other purpose.

If Thinkwork, LLC is involved in a merger, acquisition, transfer, bankruptcy, restructuring or asset sale, your Personal Information may be transferred as a business asset. We may use your Personal Information when you have given us your consent to do so.

The security of your Personal Information is important to us, and we strive to implement and maintain reasonable, commercially acceptable security procedures and practices appropriate to the nature of the information we store, in order to protect it from unauthorized access, destruction, use, modification, or disclosure.

However, please be aware that no method of transmission over the internet, or method of electronic storage is 100% secure and we are unable to guarantee the absolute security of the Personal Information we have collected from you.

Your Rights

Applicable Data Privacy Rights

To the extent that you have certain rights under applicable laws, you may exercise those rights at your discretion, and request access to, rectification of, or the deletion of your Personal Information held with Thinkwork, LLC.  You may also in some cases, request to limit the use and disclosure of your Personal Information.  If you wish to exercise any applicable rights regarding your Personal Information held with Thinkwork, LLC, please contact the Thinkwork, LLC Privacy Officer at privacy@thinkwork.com.  

Opt Out

You may choose not to receive any future promotional, marketing and advertising emails by sending an email to support@gosnapsign.com with your request to be ‘unsubscribed’ from any future related emails.  You may also be able to opt out of some Service-related emails.  To do this, you will need to change your email preferences within the Service.  Due to the nature of the Service, not all Service-related emails can be unsubscribed from.  

Choice

You are not legally obligated to provide us your Personal Information and you do so by your own choice and at your own discretion.  If you choose not to provide Personal Information that is required for the use of the Service, then you will not be able to use the Service.  

International Transfer

Your information, including Personal Information, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those from your jurisdiction.

If you are located outside of the United States and choose to provide information to us, please note that we transfer the information, including Personal Information, to the United States and process it there.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

With respect to transfer of personal data from the European Union, we and the controller shall analyze their data transfers and evaluate technical, administrative and contractual safeguards that can be used to protect the personal information from mass surveillance and, if appropriate, the parties shall execute these Standard Contractual Clauses at https://www.gosnapsign.com/company/scc/.

 

California Residents’ Rights

If you are a California resident, you have the right to request that Thinkwork, LLC disclose to you what information it collects, uses, discloses, and sells.  You also have the right to request that a business delete any personal information about you which the business has collected about you.  To submit either of the above requests, you may call Thinkwork, LLC at (646) 494-5775 or email privacy@thinkwork.com.    

Please note, for your protection, any request sent to Thinkwork, LLC to delete your personal information will be subject to the following verification procedure: 

  1.  Provide the email address and/or phone number of your SnapSign account. 
  2. Provide confirmation via email or phone call at the provided SnapSign Account email address and/or phone number to delete any/all personal information.  

Thinkwork, LLC does not sell your personal information.

Thinkwork, LLC shall not discriminate against you for exercising any of your above rights.

You may designate an authorized agent to make a request to exercise your rights on your behalf.   For your protection, we reserve the right to deny any request from an agent who does not submit proof that they have been authorized to act on your behalf.  

Thinkwork, LLC has not disclosed and/or sold personal information to third parties for a business or commercial purpose in the preceding 12 months.  Thinkwork, LLC does not sell the personal information of minors under 16 years of age without affirmative authorization.  Thinkwork, LLC has no actual knowledge that it sells personal information of minors under age 16.

Our Service may contain links to other sites that are not operated by us.  If you click on a third party link, you will be directed to that third party’s site.  We strongly advise you to review the Privacy Policy of every site you visit.

We have no control over, and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

Storage and Deletion

Thinkwork, LLC retains data for as long as we provide the Service and thereafter in accordance with our Data Retention Policy.  If you would like us to delete your Personal Information, or if you have additional questions about how your Personal Information is stored, please contact us at privacy@thinkwork.com

Children’s Privacy

Only persons age 18 or older have permission to access our Service. Our Service does not address anyone under the age of 13 (“Children”).

We do not knowingly collect personally identifiable information from children under 13.  If you are a parent or guardian and you learn that your Children have provided us with Personal Information, please contact us.  If we become aware that we have collected Personal Information from a child under age 13 without verification of parental consent, we take steps to remove that information from our servers.

Limitation of Liability  

UNDER NO CIRCUMSTANCES SHALL THINKWORK, LLC BE LIABLE FOR ANY DIRECT OR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES THAT MAY ARISE FROM A CLAIM OF BREACH OF THIS PRIVACY POLICY.  Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law, or $10, whichever is less.

Changes To This Privacy Policy

This Privacy Policy is effective as of the date set forth above and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page.

We reserve the right to update or change our Privacy Policy at any time and you should check this Privacy Policy periodically. Your continued use of the Service after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.
